CONSTITUTION OF THE KINGDOM OF ELNÄTHAR
PREAMBLE
We, the citizens and institutions of the Kingdom of Elnäthar, united by a shared commitment to cooperation, creativity, environmental respect, and responsible governance, establish this Constitution as the fundamental law of our micronation.
Recognizing the unique nature of Elnäthar as a micronational community, we affirm the principles of lawful governance, civic participation, cultural development, and peaceful relations with other nations and micronations.
Through this Constitution, we define the structure of government, the rights and duties of citizens, and the institutions that guide our micronation.
TITLE I
FOUNDATIONS OF THE MICRONATION
Article 1 — Nature of the Micronation
The Kingdom of Elnäthar is an independent micronation.
It exists as a voluntary political and cultural community.
Its authority derives from its institutions and its citizens.
Article 2 — Sovereignty
Sovereignty resides in the institutions and citizens of Elnäthar.
The governance of the micronation shall be exercised according to this Constitution.
No authority may act outside constitutional law.
Article 3 — National Symbols
Elnäthar shall possess official national symbols.
These include:
the national flag
the coat of arms
the national anthem
The adoption or modification of symbols shall require government approval.
Article 4 — Capital
The micronation may designate an official capital.
The capital may be changed through governmental decision.
Temporary administrative capitals may exist when necessary.
Article 5 — Official Language
The official language of Elnäthar is Catalan.
English may be used for international and diplomatic communication.
Other languages may be used for cultural purposes.
TITLE II
CITIZENSHIP
Article 6 — Citizenship
Citizenship represents membership in the micronation.
Citizens may participate in national life and institutions.
Citizenship is voluntary.
Article 7 — Acquisition of Citizenship
Citizenship may be granted by application.
The government may establish procedures for approval.
Citizenship may also be granted honorarily.
Article 8 — Rights of Citizens
Citizens have the right to:
participate in civic activities
express opinions freely
propose initiatives to the government
Article 9 — Duties of Citizens
Citizens have the duty to:
respect the Constitution
act in good faith toward the community
respect institutions and fellow citizens
Article 10 — Revocation of Citizenship
Citizenship may be revoked for serious misconduct.
Revocation requires governmental review.
The individual must be informed before the decision.
TITLE III
THE MONARCHY
Article 11 — The Monarch
The Monarch is the Head of State of Elnäthar.
The Monarch represents the continuity of the micronation.
The Monarch acts according to the Constitution.
Article 12 — Role of the Monarch
The Monarch shall:
represent Elnäthar ceremonially
confirm governmental decisions
protect the Constitution
Article 13 — Succession
The Monarch is chosen through a national ceremonial process.
The process shall follow the established succession ritual of Elnäthar.
The procedure may include formal voting by government members.
Article 14 — Vacancy of the Throne
If the throne becomes vacant, a succession process shall begin.
The National Council shall organize the process.
Government continuity shall be maintained.
TITLE IV
THE GOVERNMENT
Article 15 — Structure of Government
The Government consists of:
the Monarch
the Prime Minister
the National Council
other institutions established by law
Article 16 — The Prime Minister
The Prime Minister is the Head of Government.
The Prime Minister coordinates governmental actions.
The Prime Minister represents the executive administration.
Article 17 — Powers of the Prime Minister
The Prime Minister may:
organize government activity
propose laws or policies
represent the government publicly
Article 18 — Government Officials
Officials may be appointed to manage specific responsibilities.
Their duties shall be defined by the government.
Officials serve the interests of the micronation.
TITLE V
THE NATIONAL COUNCIL
Article 19 — Nature of the Council
The National Council is a central governing body.
It supports national administration and decision-making.
Article 20 — Membership
Members are appointed or recognized by the government.
Membership reflects participation in the micronation.
Article 21 — Powers
The Council may:
debate national matters
approve institutional decisions
assist in governance.
TITLE VI
LAW AND GOVERNANCE
Article 22 — Laws
Laws may be adopted when necessary for organization.
Laws must respect the Constitution.
Article 23 — Decrees
Government decrees may regulate specific matters.
Decrees must not contradict constitutional law.
Article 24 — Transparency
Government decisions should be documented.
Citizens may be informed of important actions.
TITLE VII
TERRITORY AND ENCLAVES
Article 25 — Territorial Concept
Elnäthar may possess recognized territories or enclaves.
Territories may be symbolic or administrative.
Article 26 — Creation of Enclaves
New enclaves may be recognized.
The government must approve them.
Article 27 — Administration of Enclaves
Enclaves may have local administration.
Their governance must follow national law.
TITLE VIII
ENVIRONMENTAL PRINCIPLES
Article 28 — Protection of Nature
Elnäthar values environmental protection.
Citizens are encouraged to respect nature.
Article 29 — Environmental Initiatives
Environmental initiatives may be organized by the government.
International cooperation may be pursued.
TITLE IX
INTERNATIONAL RELATIONS
Article 30 — Diplomatic Relations
Elnäthar may establish relations with other micronations.
Diplomatic recognition is voluntary.
Article 31 — Agreements
Agreements may be concluded with other communities.
These agreements must respect constitutional principles.
TITLE X
ADMINISTRATIVE STRUCTURE
Article 32 — Government Administration
Administrative responsibilities may be delegated.
Departments may exist for specific tasks.
Article 33 — Loss of Territory or Enclave
The government shall monitor the status of all enclaves.
Administrative measures may be taken if an enclave becomes inactive.
Authorities may reorganize responsibilities if territorial administration changes.
Records related to enclaves shall be preserved.
This constitutional provision establishes that, in the event that an enclave is lost, all legal and administrative activities tied to that territory are suspended and transferred to the authority of the National Council of Elnäthar.
TITLE XI
CULTURE AND COMMUNITY
Article 34 — Cultural Development
Cultural initiatives are encouraged.
Citizens may contribute to the cultural life of Elnäthar.
Article 35 — Historical Preservation
National documents may be archived.
Historical memory shall be preserved.
TITLE XII
NATIONAL ARCHIVES
Article 36 — Archives
Elnäthar may maintain a national archive.
Official documents may be preserved for historical purposes.
Article 37 — Public Records
Records may be accessible when appropriate.
Sensitive documents may remain confidential.
TITLE XIII
NATIONAL INITIATIVES

Citizens may propose initiatives.
The government may consider proposals.
Article 39 — National Projects
Projects for development or culture may be created.
Participation is voluntary.
TITLE XIV
DEFENSE AND SECURITY

Security in Elnäthar is primarily organizational.
The micronation does not maintain military forces.

Disruption of institutions may lead to sanctions.

AMENDMENTS

TITLE XVIII
FINAL PROVISIONS
Article 48 — Supremacy
This Constitution is the supreme law of Elnäthar.
Article 49 — Interpretation
The government shall interpret the Constitution when needed.
Article 50 — Continuity of Government
Government institutions shall ensure continuity of the micronation.
Article 51 — Entry into Force
This Constitution enters into force upon its official adoption.
